| Q. Who oversees the tanning industry in the United States? |
| A. Indoor tanning equipment is classified as a
medical device, and as such is overseen by the Food and Drug
Administration. It governs by way of two items of legislation,
namely, the Food, Drug and Cosmetic act and the Radiation Control
for Health and Safety Act. |
| Q.
What representations can the indoor tanning industry legally make
regarding their products and services? |
| A. Those selling the service or product of indoor
tanning may not allege any medical benefit as a result of it's use.
Indoor tanning equipment provides a controlled method to obtain a
cosmetic tan. Therefore, the tanning industry may not represent
indoor tanning as a way to feel healthier, treat the symptoms of
psoriasis or stimulate the production of vitamin D in the skin, even
though its use might accomplish all these things. The Federal Trade
Commission works closely with the Food and Drug Administration in
monitoring representations made about indoor tanning. False
representations may be forwarded to either of these agencies. |
